A will is a legal document that states who you want to inherit your estate. Your estate comprises of your money, savings, property and possessions. It is important to have a Will in order for you to ensure that your loved ones will benefit from your estate.

We recommend that you use a Solicitor when having a Will prepared. If a Will is not prepared correctly, this in the long term can result in significant legal costs being incurred. The costs of preparing a Will start from £300 plus VAT. Although there is no legal requirement to have a Solicitor, we strongly recommend that you do instruct a Solicitor. The procedure is quick and simple.

Living Will

A Living will is alternatively known as an 'advanced decision'. What this means is that it allows the individual to refuse certain types of medical treatment. This means that when and individual has a life threatening condition and is unconscious for example, if an advanced decision is prepared, the Doctor will have to take this into consideration.

An advance decision can give you peace of mind to know that if you have strong feelings about treatment that you would/would not like administered, you can have this written in a Living Will. The costs of preparing a living will can start from as little as £200 plus VAT.

Lasting Power of Attorney

A Lasting Power of Attorney (Property and affairs), alternatively known as an (LPA) allows an individual to nominate someone else to make decisions on their behalf, in relation to money and property. This LPA has to be registered with the Office of Public Guardianship.

A Lasting Power of Attorney (Personal Welfare) allows an individual to nominate someone you look after their physical well-being. This is particularly important if you are suffering from an illness and are worried about your health. Again, this has to be registered at the Office of Public Guardianship.

Although an LPA is downloadable from the Office of Public Guardianship website, it can be quite daunting to complete. If the form is completed incorrectly, it will be rejected. That is why it is usually advisable to obtain the assistance of a Solicitor when preparing an LPA. We can prepare it on your behalf for as little as £600 plus VAT.

Enduring Power of attorney

An Enduring Power of Attorney which was prepared before 1st October 2007 is still valid but has to be registered with the Office of Public Guardianship. If you have an EPA which was prepared prior to 1st October 2007 but are unsure about its validity then please contact us for further advice.
